Can members of the same family manage ancestral assets and pay tax through a separate entity?

Under Indian tax law, they may be able to do so through a Hindu Undivided Family, commonly known as an HUF. It is recognised separately from its members and can hold assets, earn income, obtain a PAN and file its own income tax return.

However, simply opening an HUF bank account does not create a new source of tax savings. The family must meet the legal conditions, and the income must genuinely belong to the HUF.

This guide explains what an HUF is, its structure, taxation, benefits, limitations, and the account-opening process.

What Does HUF Mean in Income Tax?

HUF stands for Hindu Undivided Family. HUF is treated as a separate “person” under Section 2(31) of the Income-tax Act, 1961. This means it can be assessed independently of its members.

An HUF cannot be created through a contract. It arises from the family’s legal status. However, it generally needs joint family property or income to function as a separate taxable unit.

It can:

Obtain a separate PAN

Maintain its own bank account

Own eligible movable and immovable assets

Earn rental, business, interest or investment income

Claim eligible deductions

File a separate income tax return

Pay tax independently from its members

Individual family members’ personal income does not automatically become HUF income. You must establish the source and ownership of each amount.

Who Are the Members of an HUF?

An HUF broadly consists of a Karta, coparceners and other members. Their rights and responsibilities are different.

Karta

The Karta manages the HUF’s financial and legal affairs. The Karta commonly:

Operates the HUF bank account

Signs tax and financial documents

Represents the family before authorities

Oversees assets and investments

Files the HUF’s income tax return

The senior-most coparcener generally acts as the Karta. A woman can also be the Karta when she is the senior-most coparcener.

Coparceners

Coparceners are members who acquire an interest in joint family property by birth.

Sons and daughters have equal coparcenary rights under the Hindu Succession Act. The Act recognises a daughter as a coparcener by birth in the same manner as a son.

Coparceners can generally seek partition of the joint family property.

Other Members

Other family members, such as spouses, may be part of the HUF without necessarily having the same rights as coparceners.

What Is HUF Property?

HUF property is property that legally belongs to the joint family, not an individual member.

It may include:

Ancestral property

Income generated from ancestral assets

Property acquired using HUF funds

Assets received by the HUF under a will

Gifts made specifically to the HUF

Property contributed by members, subject to clubbing provisions

Income from an eligible family business

Merely transferring personal income into an HUF account does not necessarily make it independently taxable in the HUF’s hands.

If a member transfers self-acquired property to the HUF without adequate consideration, the resulting income may be included in that member’s taxable income under the applicable clubbing rules. Professional tax advice may be necessary before transferring assets.

What Is an HUF Account?

An HUF account is a bank or investment account opened in the name of the Hindu Undivided Family.

The Karta operates it, and it must remain separate from individual members’ personal accounts. Transactions involving HUF income, expenses and assets should flow through this account to maintain a clear financial record.

Depending on the institution and applicable rules, an HUF may open:

A savings or current bank account

A fixed deposit

A demat account

A trading account

A mutual fund folio

Other eligible investment accounts

An HUF account is only an operational facility. Opening one does not by itself establish the legal or tax validity of the HUF.

What Are the Benefits of an HUF?

An HUF can offer separate ownership, succession and tax-planning advantages when it holds genuine joint family assets.

Separate Taxable Status

The HUF’s income is assessed separately from the personal income of its members.

This may distribute taxable income between the HUF and individual family members, provided the income genuinely belongs to the respective taxpayer.

Separate Tax Slab

An HUF is taxed separately at the rates applicable to it. The tax regime and slab rates depend on the relevant assessment year.

For Assessment Year 2026–27, an HUF can be taxed under the new tax regime or may opt for the old regime subject to the applicable conditions. Unlike a resident individual, an HUF cannot claim the rebate under Section 87A. Income Tax Department guidance for AY 2026–27.

Eligible Tax Deductions

An HUF may claim deductions permitted under the selected tax regime and subject to statutory conditions.

Under the old tax regime, eligible deductions may include:

Section 80C: Certain qualifying investments and payments, within the combined prescribed limit

Section 80D: Eligible health insurance premiums or specified medical expenditure for HUF members

Section 80DD: Qualifying expenditure for a dependent member with a disability

Section 80DDB: Treatment of specified diseases, subject to conditions

Section 80G: Donations to eligible funds and institutions

Section 80TTA: Eligible interest from savings accounts

Ownership of Family Assets

An HUF can hold ancestral property and other eligible assets in one recognised family structure. This may simplify managing jointly owned wealth.

Business and Investment Income

The entity may earn income from an eligible family business, property, interest, dividends or investments. The income must arise from assets or activities belonging to the HUF.

Continuity Across Generations

The HUF can continue despite a member’s death because its existence is linked to the family structure rather than one individual.

A change in the Karta does not necessarily end the entity.

What Are the Limitations of an HUF?

An HUF is not suitable for every family because its assets and decisions involve joint rights and long-term legal consequences.

Assets Do Not Belong to One Person

Property owned by the HUF belongs to the joint family.
